These terms and conditions regulate the business relationship between you and us.  By using Our Website in any way, or by buying from us, you agree to be bound by them.

No person under the age of 18 years may purchase Goods.  We look forward to seeing you again when you are over 18.

Definitions

In this agreement:

“Carrier” means any person or business contracted by us to carry Goods from us to you.

“Consumer” means any individual who, in connection with this agreement, is acting for a purpose which is outside his business.

“Our Website” means the entire computing hardware and software installation that is or supports Our Website.

“Goods” means any of the goods we offer for sale on our Website, or, if the context requires, goods we sell to you.

“Content” means any content in any form published on Our Website by us or any third party with our consent.

 

Our contract with you

This agreement contains the entire agreement between the parties and supersedes all previous agreements and understandings between the parties.  

Each party acknowledges that, in entering into this agreement, he does not rely on any representation, warranty, information or document or other term not forming part of this agreement.

Because we rely on our suppliers, we do not guarantee that Goods advertised on our website are available.

We may change these terms from time to time.  The terms that apply to you are those posted here on Our Website on the day you order Goods. We advise you to print a copy for your records.

If in future, you buy Goods from us under any arrangement which does not involve your payment via Our Website, these terms still apply so far as they can be applied.

 

Acceptance of your order

Your order is an offer to buy from us. Nothing that we do or say will amount to any acceptance of that offer until we actually dispatch the goods to you. 

Nothing said or done by us is an acceptance of an order until we confirm acceptance in writing, referring to the order.

At any time before the Goods are despatched, we may decline to supply the Goods to you without giving any reason.

We shall accept your order by e-mail confirmation.  That is when our contract is made. 

If we do not have all of the Goods you order in stock, we will offer you alternatives.  If this happens you may:

  • accept the alternatives we offer;
  • cancel all or part of your order.

 

Price and Payment

All prices are displayed in (GBP) pounds sterling and exclude VAT (we are not VAT registered). Your credit card company will make the charge in your local currency at that day’s exchange rate. We are not responsible for any other charges.

Banking charges by the receiving bank on payments to us will be borne by us.  All other charges relating to payment in a currency other than pounds Sterling will be borne by you.

The price of the items does not include the delivery charge which will be charged at the rates applicable at the date you place your order and which will be displayed on a page of Our Website before we ask you to pay.  All our payments are processed through PayPal.

 

Cancellation policy and return of faulty goods

This paragraph applies if and only if, you are a citizen of the European Union, and you bought the Goods as a Consumer.

You may cancel your order at any time before we despatch your order or before the expiry of 14 working days from the date you receive your order, not including the day you received it.

If you cancel before we have sent the Goods, we will refund to you the price of the Goods and the cost of delivery, if any.

If you cancel after we have despatched the Goods, we will refund the price of the goods only.

The option to cancel your order is not available if the Goods are:

  • made or altered to your specification;

If you cancel your order after we have despatched the Goods, you must return them to us within 7 days in the same condition in which you received them.  

In compliance with current Health & Hygiene regulations we are unable to accept the return of earrings. Your statutory rights are not affected.  

We cannot refund your money if the Goods have been used, worn or damaged.

You are responsible for the cost of returning the Goods.  We strongly recommend you obtain proof of posting as we cannot accept responsibility for parcels lost in transit.

To assist us in identifying your Goods on receipt by us, we ask you to telephone us on +44(0) 7904 024416 or email us at returns@ameliazane.co.uk .  You will need to fill in the returns form, which will be sent out with your order and send it back to us at Amelia Zane, 8 Reydon Avenue, Wanstead, London E11 2JD.

We will refund your money within 30 days of receipt by us of the returned Goods.

Each piece of jewellery has been lovingly handmade.  On rare occasions faults do occur. In the unlikely event that you find an item is faulty, please contact us immediately (contact@ameliazane.co.uk), within 7 days of receipt and we will attempt to put things right or arrange for a replacement.

In returning a faulty item please enclose with it a note clearly stating the fault and when it arises or arose.  Please note in particular that we cannot deal with your complaint unless you return the entire product that you bought: that is to say, with all components and parts and in the original packaging.

If we agree that the item is faulty, we will:

  • refund the cost of return carriage;
  • repair or replace the item as we choose.

Our decision is final.

This paragraph does not affect your rights in the event that the Goods are faulty.

 

Delivery and pick up

Deliveries will be made by the Carrier to the address stipulated in your order. You must ensure that someone is present to accept delivery, as a signature is required.  When you place an order with us you will automatically receive an electronic confirmation.  You will receive notification of dispatch usually within 2-3 working days of your order being processed. At busier times, your order may take longer to be dispatched.  We will notify you via email if this is the case.  Please be aware that we currently deliver orders only within the UK.

We may deliver the Goods in instalments if they are not all available at the same time for delivery.

Goods are sent by First Class Royal Mail recorded delivery, which will take 1-2 working days from dispatch to reach you.  We will send you a message via email to tell you when we have dispatched your order.  However, delivery times are to be used as an approximate guide only. Amelia Zane will not be held responsible for any delays caused by postal services.

 

Goods returned

Each piece of Amelia Zane jewellery has been lovingly handmade.  However, in the unlikely event that you are not entirely happy with our products, please see our 14 days returns policy below.  Please be aware that whilst we take great care to accurately describe our products, they are handmade from natural materials.  We cannot guarantee the product you receive will be exactly the same as the one you see on the website.  Due to the nature of geniune gemstone jewellery you will notice some slight variations in the tone, colour saturation, size and the shape of your stones.  These variations add to the unique nature of our jewellery.

We strongly advise that jewellery is protected from water, perfume, hairspray, deodorant and any other chemicals which may harm the finish of the beads, metal plating, semi precious stones and other findings used.  Please carefully read "TLC Tips from amelia zane" on our FAQ page before completing your purchase.

So far as possible, Goods should be returned within 14 days from receipt:

  • with both goods and all packaging as far as possible in their original condition;
  • securely wrapped;
  • including your returns form;
  • at your risk and cost.

Foreign taxes and duties

If you are not in the UK, we have no knowledge of, and no responsibility for, the laws in your country.

You are responsible for purchasing Goods which you are lawfully able to import and for the payment of import duties and taxes of any kind levied in your country.

 

Disclaimers 

We or our Content suppliers may make improvements or changes to Our Website, the Content, or to any of the Goods, at any time and without advance notice.

You are advised that Content may include technical inaccuracies or typographical errors. This is inevitable in any large website.  We would be grateful if you bring to our immediate attention, any that you find.

We give no warranty and make no representation, express or implied, as to:

  • the quality of the Goods;
  • any implied warranty or condition as to merchantability or fitness of the Goods for a particular purpose;
  • the correspondence of the Goods with any description;
  • the adequacy or appropriateness of the Goods for your purpose;
  • the truth of any Content on Our Website;
  • compliance with any law;
  • non-infringement of any right.

We are not liable in any circumstances for special, indirect or consequential loss or any damages whatsoever resulting from loss of use, loss of data or loss of revenues or profits, whether in an action of contract, negligence or otherwise, arising out of or in connection with your use of Our Website or the purchase of Goods.

Please note that the 3D printed products are intended for decorative purposes. They are not suited to be used as toys or to be given to children. The products should not come into contact with electricity and be kept away from heat.

About full colour sandstone:

This material

  • is not watertight
  • is not foodsafe
  • is not recyclable
  • is not dishwasher safe

Full color sandstone is heatproof to 60ºC / 140ºF degrees. Higher temperatures may significantly change material properties.

Your account with us

You agree that you have provided, and will continue to provide accurate, up to date, and complete information about yourself.  We need this information to provide you with the Goods.

 

Indemnity

You agree to indemnify us against any claim or demand, including reasonable lawyers’ fees, made by any third party due to or arising in any way out of your use of Our Web Site, your posting any Content, or the infringement by you, or by any other person using your computer, of any intellectual property or other right of any person.

 

Intellectual Property 

We will defend the intellectual property rights in connection with our Goods and Our Website, including copyright in the Content whether provided by us or by any other content provider (including copyright in:  text, graphics, logos, icons, images, audio clips, digital downloads, data, and software).

Except as set out below, you may not copy, modify, publish, transmit, transfer or sell, reproduce, create derivative works from, distribute, perform, display, or in any way exploit any of the Content, in whole or in part.

You may not use our name or logos or trade marks or any other Content on any website of yours or that of any other person.
